96) L. a 94) jegyzetben hivatkozott irányelv 7. cikkét, amelynek értelmében „a védjegy nem jogosítja fel tulajdonosát a használat megtiltására olyan árukkal kapcsolatban, amelyeket a Közösségben a v édjegy alatt ő maga vagy a hozzájárulásával más hozott forgalomba". Ez a rendelkezés azonban nem alkalmazható. ..ha a tulajdonosnak törvényes indokai vannak az áruk további forgalmazásával szembeni fellépésre, különösen, ha az. áruk állagát megváltoztatják vagy károsítják a forgalomba hozatalt követően." Látható, hogy e szabály visszaadja az. Európai Bíróság által kialakított közösségi jogkimerülési doktrína lényegét, s még az újraesomagolási esetek tanulságait is számításba veszi.
