1063. SZÁM. 2&3 garian citizens residing in Japán shall be subject to the jurisdiction of the Imperial and Royal Authorities. In üke manner the Japanese Authorities shall not interfere in any question which may arise betweeu Austro-Hungarian citizens and the subjects of any other Treaty Power. If an Austro-Hungarian citizen has a complaint or grievance 'against a Japanese subject, the case shall be decided by the Japanese Authorities If on the contrary a Japanese has a complaint or grievance against a citizen of the said Monarchy, the case shall be decided by the Imperial 'and Royal Authorities. Should a Japanese subject fail to discharge debts, ineurred to an Austro-Hungarian citizen or should he fraudulently abscond, the competent Japanese Authorities will do their utmost to bring him to justice and to enforce recovery of the debts. And should any Austro-Hungarian citizen fraudulently abscond or fail to discharge debts, ineurred by him to a JaDanese subject, the Imperial and Royal Authorities will do their — utmost, to bring him to justice and to enforce recovery of the debts, Neither the Austro-Hungarian nor the Japanese Authorities shall be held, responsible for the payment of any debts contracted by Austro-Hungarian or Japanese subjects. ARTICLE VI. Austro-Hungarian citizens, who may commit any erime against — Japanese subjects or the subjects of any other nation shall be brought before the Imperial and Royal Consular Ofíicer and punished according to the laws of their country, Japanese subjects, who may commit any erime againts Austro-Hungarian citizens shall be brought before the Japanege Authorities and punished accorping tho Japanese laws. ARTIOLE VII. Any case involving a penalty or confiscation by reason of any breach of this Theatry, the TradeRegulations or the Tarif annexed thereto, shall be brought before the Imperial and Royal Consular Authorities for decision. E very penalty enforced or confiscation made by these authorities shall bevalók közt támadna, a cs. és k. hatóság eldöntése alá bocsátandó. A japáni hatóságok semmi olyan peres ügybe sem fognak avatkozni, mely osztrák-magyar alattvalók ós valamely más szerződési viszonyban lévő hatalom alattvalói között támadna. Ha osztrák-magyar alattvalónak japáni ellen van panasza vagy keresete, a japáni hatóság határoz. Ellenben a cs. ós kir. hatóság határoz, ha japáni emel panaszt, vagy keresetet osztrák-magyar alattvaló ellen. Ha valamely japáni osztrák-magyar alattvaló irányában fennlévő tartozását meg nem fizetné, vagy csalási szándékkal elrejtőznék, az illetékes japáni hatóságok minden hatalmukban álló eszközt fel fognak használni, hogy az illetőt törvény elé állítsák és kényszeritsók adósságának megfizetésére. Szintúgy, ha osztrák-magyar alattvaló csalási szándókkal elrejtőznék ós adósságait japániak irányában ki nem egyenlitenó, a cs. ós k. hatóságok hatalmukhoz képest mindent el fognak követni, hogy a bűnöst törvény elé állítsák ós tartozásának megfizetésére birják. Osztrák-magyar vagy japáni alattvalók adósságainak megfizetéséért sem az osztrák-magyar, sem a japáni hatóság nem vállal felelősséget. VI. CZIKK. Osztrák-magyar alattvalók, kik bűntényt követnek el japáni vagy más nemzet alattvalói ellen, a cs. ós k. consulsági hivatalnok elé vezetendők és országuk törvényei szerint fenyitendők. Japáni alattvalók, kik bűnös cselekményt visznek véghez osztrák-magyar alattvalók ellen a japáni hatóságok elé állitandók és japáni törvények szerint büntetendők. VH. CZIKK. Minden, a jelen szerződós, a mellékelt kereskedelmi határozatok és a vámjegyzók megszegéseért járó pénzbüntetések és elkobozásokra vonatkozó igények a cs. ós kir. consuli hatóságok által döntendők el. A pénzbüntetések vagy elkobozások, melyeket az utóbbiak kiszabnak, a japáni kormány javára esnek.
