eCCXXXIII. SZÁM. 173 ARTICLE IX. When a citizen of the Austro-Hungarian Monarchy, residing permanently or temporary, in the kingdom of Siam, shall have any subject of complaint or any claim to make against a Siamese, he shall first submit his grievances to his consular officer, who after having examined the affair, shall endeavour to settle it amicably. In the same manner, when a Siamese shall have to complain against a citizen of the said Monarchy the Consular officer shall hear the complaint, and try to make an amicable settlement, but if in such cases this is impossible, the Consular officer shall apply to a competent Siamese functionary, and both after having together examined the affair, shall decide thereon according to equity. ARTICLE X. If a crime or an offence be committed in Siam and the offender be a citizen of the Austro-Hungarian Monarchy, he shall be punished by the Consular officer in conformity to the laws of bis country or be sent to his country for punishment. If the offender be a Siamese, he shall be punished by the Siamese Authorities according to the laws of the Country. Should any act of Piracy be committed on vessels of the Austro-Hungarian Monarchy on the coast or in the vicinity of the kingdom of Siam, the Authorities of the nearest place, on being informed of the same, shall afford every assistance in the capture of the Pirates, and recovery of the stolen Property which shall delivered to the Consular officer for restoration to the Owners. The same course shall be followed by the Siamese Authorities in all acts of pIIlage and robbery committed on the property of citizens of the Austro-Hungarian Empire on shore. The Siamese G-overnment shall not be held responsible for stolen property, belonging to citizens of the said Empire, when it is proved, that every means in their power have been used for its recovery ; and the same conditions shall apply equally to Siamese subjects and property, under the control of the Government of His Imperial and Royal Apostolic Majesty. IX. CZIKK. Ha a siami királyságban állandóan vagy ideiglenesen tartózkodó valamely osztr.-magyar alattvalónak egy siami ellen panasza vagy követelése van, sérelmét mindenekelőtt consulsági tisztviselőjének terjesztendi elő, ki az ügynek előleges megvizsgálása után, iparkodni fog azt békés utón kiegyenlíteni. Ep ugy, ha valamely siaminak van panasza az emiitett monarchia alattvalója ellen, a consulsági tisztviselő tartozik a panaszlót kihallgatni és a békés egyeztetést megkisérteni ; a mennyiben pedig a kiegyenlítés lehetetlen volna, a consulsági tisztviselő az IIletékes siami tisztviselőhez forduland és ezek az ügy közös megvizsgáltatása után együttesen határozandnak a méltányosság szerint. X. CZIKK. Ha Siamban bűntett vagy vétség követtetik el, a tettes, ha az osztr.-magyar monarchia alattvalója, a consulsági tisztviselő által országának törvényei szerint fog büntettetni, vagy fenyités végett hazájába küldetni. Ha a tettes siami alattvaló, a siami hatóságok által az ország törvényei szerint fog megfenyittetni. Ha a siami királyság partjain vagy azok közelében az osztr-magyar birodalom valamely hajója ellen tengeri rablás merényeltetnék, ennek hirére a legközelebbi helyhatóság minden kitelhető intézkedést megtenni köteles a kalózok elfogatására s az elrablott jószág visszaszerzésére, mely utóbbi a tulajdonosnak leendő visszaszolgáltatása végett a consulsági tisztviselőnek adandó át. Ugyanezen eljárás követendő a siami hatóságok által a fosztogatás és rablás mindazon eseteiben, melyek az osztr.magyar birodalom alattvalóinak tulajdonán a száraz földön követtetnek el. A siami kormány nem fog felelősségre vonathatni az emiitett állam alattvalóitól lopott jószágokért, ha kimutattatik, hogy minden hatalmában álló eszközt felhasznált azok visszaszerzésére, ugyanezen elv alkalmaztassák azon siami alattvalókra és azok tulajdonára is, kik ő cs. és apóst. kir. Felsége kormányának oltalma alatt állanak. ARTICLE XI. XL CZIKK.
