Résumé The Advisory Opinion of the International Court of Justice on the Independence of Kosovo The paper analyses the advisory opinion given by the International Court of Justice on the independence of Kosovo. The legal position stated in the decision of the ICJ is controversial at the very least. The General Assembly had asked the question whether the unilateral declaration of independence by the Provisional Institutions of Self-Government of Kosovo had been in accordance with international law, which sounds as a clear enough question. However, the ICJ pretended not to understand the real issue concerning Kosovo and avoided addressing the problem of the right to self-determination. The ICJ decided that the unilateral declaration of independence by Kosovo was in compliance with international law without saying a word about the precondition of the declaration of the independence, i.e. self-determination. Therefore the advisory opinion may not be regarded as a milestone in the history of the international law, contrary to the expectations of many who had hoped for such a historic decision. 2010. tél 77
