Résumé The Catholic Church Is a Unitary International Contracting Party I try in this essay to surpass the input loss coming from the too severe a priories of state criteria of the international law such a way that I approach the diplomatic relations and treaties between the Church and the states from the usual point of view of the international relations discipline. My starting point is how the parties look at each other when they enter into diplomatic relations or bond international treaties, namely how the secular party looks at the ecclesiastic one. I conclude that the foreign relations between the Church and the states are better explicable on the basis of the more practical epistemological mechanism of the international relations discipline than on the basis of the international law. In fact the principal questions of a state is not that in what grade the Church fulfills the requirements of the manuals of international law. The point for the secular party from the point of view of its foreign policy that is 1) the secular party can negotiate with a governable and governed entity 2) if the secular party bonds international treaty with the Holy See, the Holy See will be able to fulfill the treaty with the part of the Catholic Church funtioning on the territory of that country, as the Holy See has been able to validate its treaties with the parts of the Catholic Church functioning on the territory of that countries as well. The Holy See in its international relations represents the whole Catholic Church, which has an own auto-reflection as the government of it. The diplomatic and treaty partners of the Church can well perceive this governmental function. This function of representation of the whole Church is perceiveable and reflectable by the epistemological mechanism of the international relations discipline, in spite of the fact that the international public law manuals accept this mechanism with difficulties in consequence of the limits of their own paradigm. 2008. tavasz 143
