652 Bényey Zoltán старается ухватывать тенденции, прочитываемые из технико-зкономических и из экономических перспектив, а также из общей юридической окружающей среды государственной власти. По мнению автора при развитии водного права можно и надо исходить именно из сегоднящего общественного распределения труда в области водного хозяйства, а также из установленных учреждений водохозяйственной организации, системы задач и сферы действия государственной власти. Надо учитывать, что водное хозяйство представляет собой неразделимую единицу, которой соответствует только центральное управление и согласованная работа характерных для него организационных систем, поэтому считается необходимым его функционирование в специальной отраслевой системе по государственным заданиям. Наконец автор излагает некоторые свои представления о всеобщем действии правотворческой воли в акте создания юридических норм. По его мнению при развитии правового дела внимание надо концентрировать на - структуральное право (развитие системы), - планируемое и согласуемое правотворчество внутренней необходимости и - системные элементы со специальным водохозяйственным содержанием. * * * Development principles in water legislation by Dr. Zoltán BÉNYEY, Legal Adviser The development of water legislation comprises, on the one hand, the efforts at updating the legal provisions related to water and, on the other hand, the improvement of the effectiveness of water law enforcement. Updating is pursued with two immediate objectives in mind, viz. to adjust the legal provisions to the current water management conditions by exploring general and specific socio-economic environment, as well as the requirements of legislation advancement, further to lay the foundations for the incentive-orienting, guiding functions of the water law. The improvement of law enforcement implies the perfection, and if necessary formal transformation of the administrative mechanism. The principles of law development are discussed in relation to the socio-economic trends of water management in Hungary, examining these in the technico-economic perspectives, the economic outlook and before the background of general administration law. The current social division of labour in water management, the established institutional pattern of the water management organization and functions, further the existing hierarchy of administration are identified as the starting conditions of water legislation development. The integrated unity of water management must be taken into consideration along with the fact that this integration presumes central guidance, control and concerted functioning of an organizational pattern tailored to specific requirements. It is for this reason that water management must necessarily be operated in a special sectorial system as a function of state administration. Finally the Author presents his views about the effects of the legislator's intentions on the procedure of legislation. According to his opinion legislative development should be focussed on: -- structural (legal system improvement) law - spontaneously initiated but plannable - harmonizable legislation - elements of the legal system containing professional water management rules.
