238 1062. SZÁM. shall afford every assistance in the captare of the Pirates, and recovery of the stolen Property which shall delivered to the Consular officer for restoration to the Owners. The same eoirse shall be followed by the Siamese Authorities in all acts of pillage and robbery committed on the property of citizens of the Austro-Hungarian Empire on shore. The Siamese Government shall not be held respnsible for stolen property, belonging to citizens of the said Empire, when it is proved, that every means in their power have been used for its recovery; and the same conditions shall apply equally to Siamese subjects and property, under the control of the Government of Bős Imperial and Royal Apostolié Majesty. 1RTICLE XII. On the Imperial and Royal Consular officer sending a written application to the Siamese Authorities, he shall receive from them every aid and support, in detecting and arresting sailors or other citizens of the Austro-Hungarian Eaipre or any individuals uuder the Protectiou of the Inperial and Royal Consular flag. On the requisition of the Imperial and Royal Consular officer he sha'l alsó récéivé from the Siamese authorities every aid and assistance and such force as may be necessary toenable him to give due effect to his authority over the citizens of the Austro-Hungarian Monarchy and to enforce discipl.ne among shipping of the AustroHungarian Monarchy in Siam. In liké manner should a Siamese guilty of desertion or árny other crime, take refuge in the house of a Citizen of the Austro-Hungarian Empire, or on board a vessél of this Empire the local Authorities shall adress themselves to the Imperial and Royal Consular officer and he shall on proof of the culpability of theaccused immediately authorize his arrest. All concealment and connivance shall be carefully avoided, by both parthies. ARTICLE XOI. Should a citizen of the Austro-Hungarian Monarchy engaged in business in the Kingdom of Siam "becoine bankrupt, the Imperial and Royal Consular officer shall take possession of all his goods, in order that tho same may be tistributed dóst megtenni köteles a kalózok elfogatására s az elrablott jószág visszaszerzésére, mely utóbbi a tulajdonosnak leendő visszaszolgáltatása végett a consulsági tisztviselőnek adandó át. Ugyanezen eljárás követendő a siami hatóságok által a fosztogatás ós rablás mindazon eseteiben, melyek az osztr.-magyar birodalom alattvalóinak tulajdonán a száraz földön követtetnek el. A siami kormány nem fog felelősségre vonathatni az emiitett állam alattvalóitól lopftt jószágokért, ha kimutattatik, hogy minden hatalmában álló eszközt felhasznált azok visszaszerzésére, ugyanezen elv alkalmaztassák azon siami alattvalókra ós a/.ok tulajdona, a is, kik ő cs. és apóst. kir. Felsége kormányának oltalmi alatt állanak. XII. CZIKK. A siami hatóság )K a cs. és kir. consulság tisztviselőnek írásbeli megkeresésére kitelhető segítséget ós pártfogást nyújtsanak a hajós bgfayekntk vagy az osztr.-magyar birodalom más alattvalóinak, ós egyéb a cs. és kir. lobogó oltalma alatt álló személyeknek megkeritésére és elfogatására. Szintúgy a cs. ós királyi eonsulátusi tisztvisel, a siami hatóságoktól, ha hozzájuk folyamodik, minden szükséges segélyt és elegendő legénységet nyerend a végből, hogy tekintélyének az osztr.-magyar birodalom alattvalói fölött kellő érvényt szerelhess n, ós a fegyelmet az osztr.-magyar' tengerészeinél Siamban kényszereszközökkel is fenntarthassa. Hasonló módon, ha valamely a szökés vagy más büntetésben vétkes siami, az osztr.-magyar birodalom egy alattvalójának házába vagy ezen állam egy hajójára menekült volna, az ottani hatóság a cs. ós királyi consulsági tisztviselőhöz forduland, ki a vádlott bűnösségének bebizonyodása után annak befogatását azonnal helyben hagyandja. A vétség minden eltitkolása ós segítése mind két részről a legnagyobb figyelemmel akadályozandó. XIII. CZIKK. Ha az osztr.-magy. monarchia valamely alattvalója, ki a siami királyságban üzletet folytat, fizetésképtelenné válnék, a csász. és kir. consulátus tisztviselő összes vagyonát lefoglalandja, hogy azt a hitelezők közt követeléseik arányában elosztassa,. •
