János Bárth Fishermen before the archbishopric court The fishing on the first and second class fishery waters belonged to the seigniorage in Hungary during the 18th and 19th century. This is shown by the contracts between Archdiocese of Kalocsa as the landowner of the Lower Danube area and the village communities and fishermen tenants. According to the customary law serfs were able to fish to supply their needs. They were allowed to use third class waters, such as waters near to their villages and on lands covered with floodings. The fishermen tenants tried to restrict the fishing practice of peasants in the low-value fishing waters. Due to this fact many conflicts were generated between the tenants and the fishing serfs. The author cites archival documents between 1827 and 1828from the archbishop court of Kalocsa. At that time a relatively large number of peasants were brought to justice because of illegal fishing. These lawsuits show what social groups were involved in such cases. Also they tell us what species of fish were caught in waters levels and flood-covered pasture. [Translated by the editor] 32
