The family and its legal customs: customary law of taking care of the elderly in the Danube-Tisza Interfluve Region

The traditional rules defining by whom and how should care be taken of elderly people have always been a very special part of Hungarian legal ethnography focusing on legal customs of a traditional family. The current paper aims to describe such legal traditions, based on ethnographical data collections, archives, and scientific literature. Although the Danube-Tisza Interfluve Region is home to diverse ethnic groups and minorities, the customary law related to the care for elderly people within the family is best documented in the case of German and South Slavic (Serbian and Croatian) ethnic groups, as well as Székelys from Bukovina and people living in the Sárköz Region near Kalocsa. These selected cases are typical examples representing the everyday practice in a traditional family between the second half of the 18th and the middle of the 20th century. These examples and the differences between typical scenarios help to better understand, how various systems intended to ensure caretaking have evolved in the examined communities. The diversity and careful preservation of these systems in traditional communities also emphasizes the importance of legal customs in shaping everyday life. [Translated by Tamás Szabó G.]
