Az Ó- és Újszövetség korának jogi gondolkodásából, kialakított jogelveiből, néhány a mai napig is ismert és érvényben lévő eljárási alapelv (ártatlanság vélelme, nyilvánosság elve), azonban a jogi gondolkodás merőben más alapokra helyeződött: a törvény már nem az isteni kijelentésből meríti érvényét, hanem az állam kényszerítő erejéből. A megszegett törvény már nem az Isten, csupán az állam rendjét sérti; a büntetés nem a bibliai értelemben vett bűn, csupán a törvényszegés következménye. Egyedül az egyházjog területén maradt létjogosultsága a bibliai jogfelfogásnak, ahogyan azt Kálvin János is megfogalmazta az egyházi bíráskodással kapcsolatban: nem szabad sohasem szem elől téveszteni, hogy Isten szolgái vagyunk, így ,Az egész tárgyaláshoz pedig Isten nevének segítségül hívásán kívül oly méltóság illik, amelyen érezhetőnek kell lennie Krisztus jelenlétének, hogy így semmi kétség ne férjen ahhoz, hogy egyenesen ő ül ítélő széke élén.”30

ABSTRACT

The Judges Role and the Practice of Passing Judgement in the Scriptures

This study aims at outlining legal proceedings in the Scriptures, with special attention to criminal procedures. To do so, it is essential to start with presenting the unique covenant made with God which defines the Jewish legal system. For this covenant itself is a source of law, but it also gives the binding force of the law. God’s pronouncements are the law, secular jurisdiction is not separated from religious jurisdiction; the whole legal system is sacred in nature penetrating the whole administration of justice. The person and the role of the one pronouncing the verdict is of outstanding importance, therefore, the status of the judge will be presented in detail. The judicial practice of the New Testament era rests on Old Testament foundations; the most important criminal proceeding is the case against Jesus; by examining this lawsuit we get an insight into the legal approach of that time.
