Otherwise, the pope will withdraw favour from him, and prohibit divine service „in Albensi ecclesia, ubi sedes regalis est.” And in Totiens iam, to the Hungarian suffragans, the provosts, abbots and magnates, and all the clergy and people „per regnum Ungarie constituto”, the pope laments their failure to act on previous papal letters. Having fully heard Lucas’s charges against Andreas, including violence against Lucas’s clerks, the pope declared Andreas immune or absolved. He has deferred to Lucas’s more than is proper, and now orders under pain of anathema any of the recipients who continue to avoid Andreas to be themselves avoided as excommunicates; and if Lucas continues his charges against Andreas, he is to be deprived of the obedience of his own subjects.16 * * * Si velis: WH 919, JL - , c. To the archbishop of Esztergom Ad apostolice sedis Lucius III to the archbishop of Esztergom, on tithes, delegated jurisdiction, appeals and clerical immunity Ad apostolice sedis, to the archbishop of Esztergom, is the only decretal of Lucius III (1181-85) to Hungary in the collections, and in it the pope replies to a series of questions raised by the archbishop. It deals firstly with a custom which has grown up in Hungary (wrongly transcribed as Anglia in Tann. and Sang.), whereby people move from one diocese to another, but are required by both bishops to pay tithes, even after residing there a long time. The pope declares that, in respect of manufacture, trade or agriculture, tithe should be paid to the church in which divine service is heard and the sacraments received throughout the year.
