IUS CANONICUM - José Miguel Viejo-Ximénez, The Summa Quoniam in Omnibus revisited

THE SUMMA QUONIAM IN OMNIBUS REVISITED 155 De origine vero iuris is the third block of twenty-seven lines (Sch 1.20 - 2.22), a mixture of sentences on this subject taken from four of Gratian’s dicta.6 With Ostenso constitutionum divinarum a new block of thirteen lines begins on ecclesiastical decrees (Sch 2.23 - 3.3a), again from ICTh. The fifth block. Sub hoc enim sancii (Sch. 3.3b - 7), has only five lines on the Nicene Council that are similar to D. 15 c. 1 corresponding phrases. Que omnia tam conciliorum is the last block (Sch 3.8 - 34a), twenty-seven lines once again taken from ICTh. The closing three lines after this composition of six blocks explain that Gra- tian wrote De consecradone, the third part of the Decretum. These three lines (actually, two and a half lines: Sch 3.34b - 36) are an addition to the sixth and last block based on ICTh. According to this introduction, then, Gratian finished his work with the causae, the second part of the Decretum. This is a clear indication of when ICTh was written: the oldest manuscripts of Gratian offer a work without De consecratione;7 and an early gloss speaks of a Concordia discordan- tium canonum ‘in duas partes divisa' .* In the circle of people who worked in Gratian’s team, or right after him, seniority didn’t belong to the author of Quo- niam in omnibus but to that of Inter ceteras theologiae. Whether or not they 6 ex D. 1 pr. (= Sch 1.23-2.la), ex D. 5 pr. (=Sch 2.lb—3a), ex D. 6d. p. c. 3 (= Sch 2.3b-12a) and ex D. 7 pr. (= Sch 2.12b-20, with Deut 15, 12-17). 7 The oldest manuscripts of Gratian are Aa, Be, Fd, P, Sg, Pfr: cf. Winroth, A., The Two Recensions of Gratians Decretum, in ZRG Kan. Abt. 83 (1997) 22-31.
