97L SZAE. 31ft by the exhibition of the ship's register and list of the crew, or else, should the vessél have sailed previously, by producing an authenticated copy of these documents showing that the persons claimed really do belong to the ship's crew. Upon such request the surrender of the deserter shall not be refused. Every aid and assistance shall moreover be grahted to the said Consular authorities for the detection and arrest of deserters, aud the latter shall be taken to the prisons of the country and there detained at the request and expense of the Consular authority until there may be an opportunity for sending them away. The duration of this imprisonment shall not exceed; the term of three months, at the expiration of which time, and upon three days notice to the Consul, the prisoner shall be set free and he shall not be liable to re-arrest for the same cause: Should, however, the deserter have committed on shore an indictable offence, the local authorities shall be free to postpone his extradition until due sentence shall have been passed and executed. The High Contracting Parties agree that seamen, ar other individuals forming part of the ship's crew, who are citizens of the country in which the desertion took place, shall not be affected by the provisions of this Article. AETIOLE XIII. In all cases where no other agreement to the contrarye xists between owners, freigthers and insurers, all damages suffered at sea by the vessels of the two countries; wheter they enter the respective ports voluntarily or by stress of weather, shall be settled by the Consuls-General, Consuls, Vice-Consuls or Consular Agents of their respective nations provided no interests of citizens of the country where the said functionnaries reside, nor of citizens of a third power are concerned. In that case, and in the absence of a friendly cempromise between all parties interested, the adjudication shall take place under supervision of the local authoritiess, ARTICLE XIV. In the event of a vessél belonging to the Goezen okmányok hiteles másolatainak bemutatása által tartozván kimutatni azt, hogy a keresett egyének valóban a hajólegénységóhez tartoznak. Az ily módon igazolt megkeresésre a szökevény kiszolgáltatása meg nem tagadható. Azonfelül a nevezett consuli hatóságoknak minden kitelhető támogatás ós segély fog nyújtatni a szökevények felfedezésére ós elfogatására, kik is a consuli hatóság megkeresésére ós annak költségén fognak az ország börtöneiben mind addig letartoztattatni, mig alkalom akad elszállításukra. Ezen fogság azonban három hónapon túl nem tarthat, s ez idő elmultával a consulnak három nappal előbb törtónt tudósítása után a fogoly szabad lábra fog helyeztetni ós ugyanazon okból újra többé el nem fogható. Ha azonban a szökevény szárazon követett volna el valamely büntetés alá eső cselekményt a helybeli hatóságnak szabadságában áll a kiszolgáltatást akkorra halasztani, mikor a birói ítélet felette meghozatott és végrehajtatott. A magas szerződő felek megegyeznek arra nézve, hogy oly tengerészekre vagy a hajó legénységéhez tartozó oly más személyekre, kik azon országnak polgárai, melyben a szökés történik, a jelen czikk határozatai nem alkalmazhatók. XIII. CZIKK. Mindazon esetekben, melyekben a hajótulajdonos, a rakomány tulajdonosa ós a biztosító közt kötött egyezmény ellenkezőt nem határoz, azon kár esetek, melyek a két ország hajóit a nyilt tengeren érték, ha a hajó akár önként, akár az időjárás által kényszerítve egymás kikötőibe fut be, a hajó nemzetének főconsulai, consulai, alconsulai vagy consuli ügynökei által tárgyaltatnak, feltéve, hogy azon országnak, melyben a mondott tisztviselők laknak vagy pedig egy harmadik hatalmasságnak polgárai nincsenek egyúttal érdekelve. Ez utóbbi esetben ; ós ha [valamennyi érdekelt fél között békés egyesség nem jő létre, a káreset letárgyalása a helybeli hatóságok által eszközöltetik. XIV. CZIKK.
