second degree of the fourth rank, who after having communicated to each other their respective full Powers and proper form have agreed upon the following Articles : ARTICLE I. There shall be perpetual peace and friendship between the high contrasting Powers and their respective subjects. ARTICLE II. His Imperial and Royal Apostolic Majesty shall have the right to appoint a diplomatic Agent, a Consul General, and for every port or town in Japan open to foreign trade a Consul, Vice-Consul or Consular Agent ; these Officials shall have the same privileges and rights as those of the most favoured nation. The diplomatic Agent oppointed by His Imperial and Royal Apostolic Majesty as well as the Consul General shall have the right to travel freely in any part of the Japanese Empire. Likewise those Imperial and Royal Consular Officiers who are entrusted with judical powers, shall have the right whenever an Austro-Hungarian ship is wrecked, or an attack is made upon the life and property of an Austro-Hungarian citizen within the limits of their jurisdiction, to proceed to the spot, in order to collect such evidence as may be necessari. But in every such case the Imperial and Royal Consular-Officers shall inform the Japanese Local-Authorities in writing of the object of their journey and the place to which they intend to proceed, and shall undertake this journey only in the company of a high Japanese officer to be appointed by the Japanese Authorities. His Majesty the Emperor of Japan may oppoint a diplomatic Agent at the Court of Vienna and Consular Officiers at any port or town of the Austro-Hungarian Monarchy where Consular Officiers of any other power are admitted to reside. The diplomatic Agent and the Consular officiers of Japan shall under the condition of reciprocity, enjoy in the territory of the Austro-Hungarian Empire the same rights, privileges and immunities, which those of any other Power now enjoy or may hereafter enjoy. osztályából, kik meghatalmazásaik kölcsönös közlése után, miután azokat jó és kellő alakban kiállitottaknak találták, a következő' czikkekben állapodtak meg;: I. CZIKK. A magas szerződő álladalmak és azok alattvalói között örök béke és állandó barátság uralkodjék. II. CZIKK. . 0 csász. és apostoli királyi Felsége jogában áll egy diplomatiai ügyvivőt, egy főconsult és japán minden nyilt kikötőjében vagy ilynemű" városában egy consult, al consult vagy consuli ügyvivőt kinevezni. Ezen hivatalnokok ugyanazon szabadalmakat és előjogokat fogják élvezni, mint a legkedvezményezettebb nemzet hasonló hivatalnokai. Ugy az O csász. és apóst, királyi Felsége részéről kinevezett diplomatiai ügyvivő, valamint a fŐconsul is szabadon és akadálytalanul utazhatnak a japáni császárság minden részeiben. Hasonlag szabadságában áll a biráskodás gyakorlására feljogosított cs. és kir. consuli hivatalnokoknak, hogy az esetben, ha a törvényhatóságuk kerületében osztrák-magyar hajó hajótörést szenvedne, avagy osztrák-magyar alattvaló élete vagy tulajdona megtámadtatnék, a tényállás fölvételére a helyszinén megjelenhessenek. A cs. és kir. consuli hivatalnokok azonban kötelesek minden ilyen esetben írásban értesíteni a japáni helybeli hatóságot utazásuk czélja és okáról, és csak is a japáni hatóság részéről kijelölendő magasabb hivatalnok kíséretében indulhatnak útnak, A japáni császár diplomatiai ügyvivőt nevezhet a bécsi udvarhoz és consuli hivatalnokokat az osztrák-magyar birodalom mind azon kikötőibe és városaiba, melyekben bármely más állam consuli hivatalnokai működésre bocsáttatnak. A japáni diplomatiai ügyvivőt és consuli hivatalnokokat a kölcsönösség föltétele mellett az emiitett monarchia területén mindazon jogok, kedvezmények és szabadalmak illetik, melyeket bármely más állam ily hivatalnokai jelenleg élveznek vagy jövőben élvezni fognak.
