Tanulmányok - Blazovits László: Megjegyzések a Középkori Szeged, Gyula és Debrecen lakóinak magánjogi helyzetéhez
Hajdú-Bihar Megyei Levéltár Évkönyve XXXI. 29 Some remarks on the status of private law of the inhabitants in the medieval tow ns of Szeged, Gyula and Debrecen László Blazovits In Hungary the right of a medieval town had two juridictions and there were not so rigorous differences between them. To the east of the line of Pozsony, Buda and Kassa the Saxon mirror can be detected while to the south of that line the Swabian mirror can be seen. This fact can be observed in the civil law of the town mainly in the order of succession. The citizen, who kept the rule of the order of succession, could be free to dispose of his own property. His wife could do the same, too. In the north the surviving spouse inherited after the testator the half of the property. The child or children inherited the other half of it. To the south of the above mentioned line, the child and the surviving spouse inherited equally one part of the property. In the market town inhabitants inherited according to the right of a serf. In Debrecen, though the power was wielded by the squire, the rule was similar to the rights of a market town. The survivors inherited after the testator, each. All this shows that Debrecen was a town belonging to a squire, whereas the inheritence was the same as in Buda, women had their own property in the marriage. This form introduces evidence that the rule of inheritence differs from that of the other market towns.
