BÉNYEY, Jurist The development of water law and its role in the water service of Hungary was analyzed by the author in three steps: - what are the social-economical bases of contemporary water law; - what transforming and modifying trends are recognized in the motion processes of water law; - what was in the midst of these transforming and modifying effects the flexibility and volume-capacity of water law. According to the author, the Water Act of 1964 - valid also today - played a definite role in the development of water law. The period before its edition - between 1948 and 1964 - was characterized by the foundation of an up-to-date water management system, by structural changes in the traditional (classical) water engineering work and by the preparation of the main chapters of our water law. The 20 years elapsed since 1964 can be subdivided into two main periods (1965-75 and 1976-83) from the point of view of the operation and development of all substantial elements in water management. In the first sub-period the development-peaks were attained in the history of Hungarian water management. It was the result of a rare constellation of the internal and external factors of development. In the second sub-period the pace of development slowed down in some areas. It was, however, an adequate opportunity to grow up to the requirements set against it by the national economy despite the fact, that the basic conditions to satisfy the basic demands of the society became more difficult. The tendencies that were triggered by the general economic situation and by the specific development in the water sector increased the requirements set against water law. The functioning of water law - as far as the theories and systems embedded in the Water Act are concerned - may be considered as satisfactory. Even the rules in water management law proved to be time-resistant. The number of created and withdrawn legal rules during the time-period elapsed since the authorization of the Water Act was compiled in Table I by the author. As far as the efficiency of law application is concerned, the author concluded that legal authoritative work - despite its significance and considerable development - was less effective than planned and required. * * * Entwicklung des Wasserrechtes von Dr. jur. Zoltán BÉNYEY Der Verfasser untersucht die Entwicklung des ungarischen Wasserrechtes, bzw. seine im ungarischen Wasserwirtschaftsdienst gespielte Rolle, in den folgenden drei Schritten: - Auf der Basis welcher Grundlagen ist das heute gültige Wasserrecht entstanden? - Welche gestaltende und modifizierende Richtungen zeichnen sich ab in den Bewegungsprozessen des Wasserrechtes? - Wie hat sich die Anwendungselastizität, die Aufnahmefähigkeit des Wasserrechtes infolge dieser gestaltenden-modifizierenden Einwirkungen geändert? In der Entwicklung des ungarischen Wasserrechtes kommt dem 1964 entstandenen und auch noch heute gültigen Wassergesetz (WG) eine außerordentlich hohe Bedeutung zu.
