FRATERNAL BENEFIT SOCIETY Washington. D. C. 1984 EDITION BY-LAWS 83. Appeals from disciplinary action to be heard by: In case of a member the Executive Committee. An officer of branch: the Executive Committee. A salaried employee: the Board of Directors. A National Officer: the Convention. A member of the Board of Directors: the Convention. 84. Disciplinary proceedings shall be instituted by filing a written complaint with the President of the Federation. The President shall refer the matter to the Executive Committee which in turn shall forward it to the Executive and Organizing Committee. The Committee will evaluate the charges and determine whether hearings are in order. Hearings shall be held as soon as may be convenient and decisions rendered immediately. Written notice of appeal shall be filed within one month from the date of decision. Decisions at hearings and appeals shall be made by majority vote of those present and voting. 85. Punishment of those found guilty in dis­ciplinary proceeding shall be determined by the group conducting the hearings and may be: a) reprimand. b) suspension of membership privileges for a certain period of time. c) Permanent suspension of membership pri­vileges. ARTICLE X PROPERTY - INCOME - FUNDS 86. The property of the Federation shall consist of all assets of every kind and nature now belonging hereto and all that which in the future shall arise from membership dues, assessment rates under certificates and endorsements issued by the Federation, income on investments, donations, bequests, or anything which shall be otherwise acquired by the Federation. 87. The income of the Federation shall consist of dues, assessments on certificates, income on in­vestments, bequests, or any other money received by the Federation. 88. All the property and income of the Federa­tion shall constitute and shall be handled in the following funds: a) The life insurance fund. b) The sick benefit fundg c) The hospitalization fund. In addition to the above, the Federation may handle as trustee other funds for which it is accountable. The accounting of all funds shall comply with the laws of the respective states and provinces. No member, beneficiary or any other person, association or corporation shall have any property right whatsoever in any of these funds except as may be provided for by these by-laws. ARTICLE XI INSURANCE DEPARTMENT ADULT INSURANCE PLANS Certificates — Dues — Age — Amount of Insurance — Change in Plan — Tables of Rates 89. In accordance with the rights granted in its charter, the Federation extends to its members life and accident certificates containing the respective rights and obligations of membership, as issued from time to time in accordance with plans approved by the respective states. 90. Applicants for membership shall pay dues for their certificates according to age nearest to their birthday at the date of application. 91. The Federation issues certificates of in­surance to one hundred thousand dollars ($100,000.00) between the ages of 16 and 70. Accidental death certificate riders may be issued to the face amount of the certificate. 92. A member may have his plan or amount of insurance changed to any other plan or amount to the limits prescribed in these by-laws. Terms, conditions and new rates shall be requested from the Vice President-Secretary. ARTICLE XII THE CERTIFICATES Issuance — Validity — Encumberance Assignments Legal Action — Restrictions — Valuation 93. Every certiciate issued shall be accepted by the member upon the express condition that the certificate and any riders and endorsements, the charter of articles of incorporation, the by-laws of the Federation, the application for membership and the declaration of insurability signed by the applicant with all amendments to each thereof, shall constitute the entire contract between the Feder­ation and the member. 94. If the age of the insured member has been misstated, the amount payable under the certificate shall be such as the monthly rate would have purchased at the correct age, provided, that if the correct age was not an insurable age under the Federation’s by-laws, payments shall be limited to the net mortuary payments made without interest. 95. Any computation of withdrawal equities is based upon age at issue and the number of certificate years and upon the assumption that all payments have been made for the full period referred to; that there is no indebtedness to the Federation what­soever and that the required reserve is then intact. The existence of a certificate loan on the date any withdrawal equity becomes effective will result in a reduction of any cash surrender value by the amount of the loan, or an appropriate adjustment in the amount of paid-up insurance or the amount and period of extended insurance. 96. No assignment of the certificate shall be binding on the Federation, with a sole exception of an assignment to the Federation itself, without its expressed consent, nor are the benefits liable to attachment, garnishment or other process, nor can they be seized, taken, appropriated or applied by any legal or equitable process or operation of laws to pay any debt or liability of an insured member or of the beneficiary or beneficiaries named in the certificates. 97. No action at law or in equity shall be brought or maintained on any cause or claim arising out of membership in the Federation or any beneficiary certificate thereof, unless said action is commenced within three years from the time the cause of action accrues. 98. The Federation will annually value all its certificates maintaining thereon the reserve required by the various Experience Tables of Mortality. If the valuation annually made discloses that such reserves are impaired, a special assessment may be levied to protect the interest of the insured members; and upon failure of any member to comply with such lawful arrangement, his or her certificate may be charged with its proportion of such a deficiency, as a lien, to be deducted, together with interest at the rate of 5% per annum, compounded annually, in any settlement thereunder. As an alternative, a member may request a reduction of the corresponding insurance benefit proportionate to the value of the additional contributions. ARTICLE XIII JUVENILE CERTIFICATES Membership — Amount of Benefits — Dues Suspension — Reinstatement — Beneficiaries 99. The Federation issues juvenile life, endow­ment and accident insurance certificates for children under 16 years of age. 100. The Federation issues certificates of in­surance to $25,000 dollars. The accidental death certificate rider may be issued in the face amount of the certificate after age 1. 101. All juvenile members automatically and without extra charge become members of the adult insurance department when they reach their 16th birthday. 102. If the applicant named in the juvenile certificate shall die, the certificate may be continued in force on the life of the insured member by any person legally responsible for his support and maintenance, and who shall assume payment of the required monthly dues. ARTICLE XIV TRUST FUND Unclaimed and Abandoned Property 103. Claims under any certificate or rider shall be submitted on forms prescribed. The furnishing of such forms shall not constitute an acknowledgement of liability nor be deemed a waiver of any rights or defenses available to the Federation, nor shall it be deemed a waiver of the right to demand further proofs.
