one official of the branch or a notary public, sending the same, with his original certificate to the Vice President-Secretary. The change of beneficiary shall be effective upon signing of such request in the presence of the branch manager or a notary public. 77. The beneficiary has no vested rights. When the member desiring to change his beneficiary has been legally adjudged insane and a certified copy of such judgment or decree has been furnished to the office of the Vice President-Secretary, such member cannot ask for change of beneficiary. 78. In case a member has lost his certificate or if a certificate comes into the possession of any unauthorized person who refuses to part with it, the member desiring to change his beneficiary must attach to his petition for this change an affidavit signed in the presence of a notary public annulling his previous certificate and requesting a duplicate certificate containing the name of his beneficiary. ARTICLE IX DISCIPLINING MEMBERS Aim — Offenses — Procedure — Appeals 79. The aim of disciplining is not punishment, but correction. Judgment should not be too severe, and expulsion from membership may be invoked only in cases of serious and repeated violations of the by-laws. With reference to the beneficiary, the certificate holder may keep his certificate in force but shall not exercise any rights of elective or voting privileges. 80. Disciplinary proceedings may he instituted upon the following grounds: a) Refusal to comply with directions from higher authority. b) Actions in contradiction of the by-laws. c) Agitation, in any form, against the Federation. d) Behavior contrary to law or good morals. e) Failure to perform duties in the best interest of the Federation. 81. Disciplinary proceedings shall he commenced by: In the case of a member: the president of the branch. In the case of a branch officer: the branch, or the President of the Federation. A salaried employee: the Executive Committee. A National Officer: the Board of Directors. A member of the Board of Directors: the Board of Directors. 82. Hearings in disciplinary proceedings to be held by: In case of a member: the branch. An officer of branch: the branch. A salaried employee: the Board of Directors. A member of the Board of Directors: the Board of Directors. 83. Appeals from disciplinary action to be heard by: In case of a member: the Executive Committee. An officer of branch: The Executive Committee. A salaried employee: the Board of Directors. A National Officer: the Convention. A member of the Board of Directors: the Convention. 84. Disciplinary proceedings shall be instituted by filing a written complaint with the secretary of the group authorized to conduct the hearing. Hearings shall be held as soon as may be convenient and decisions rendered immediately. Written notice of appeal shall be filed within one month from the date of decision. Decisions at hearings and appeals shall be made by majority vote of those present and voting. 85. Punishment of those found guilty in disciplinary proceedings shall be determined by the group conducting the hearings and may be: a) reprimand b) suspension of membership privileges for a certain period of time. c) Permanent suspension of membership privileges.
