Paul St. Miklossy, Feb. 10, 1964 Treasurer IS THERE SOME WAY I CAN HAVE MY ILLEGITIMATE SON JOIN US IN THE U. S.? Question: Both my wife and I are American citizens by naturalization. Before I came to the United States I had an illegitimate child. The mother disappeared, leaving me with the baby. I have brought up the child and when I married, my wife treated the child as if he were her own. We had to leave the child when we immigrated, because we all come from a country with a heavily oversubscribed quota, but we are most anxious to have him join us. Is there any way in which this can be done? Answer: Whether the child can join you depends on his age. If he is under 14 years old, you and your wife may petition for him as an “orphan”. The Immigration law provides for special non-quota visas for “eligible orphans” coming to the United States for adoption, if their natural parents have disappeared or abandoned them. The child comes within this category, because the natural mother has abandoned him and the natural father, namely you, is in the United States. However, an “orphan” under this provision of the law must be under the age of 14. If the child is over 14, you cannot obtain a preference for him, because under the law an illegitimate child can obtain a preference only by virtue of the relationship of the child to its mother, and not to its father.
