az 1722—1723. évi magyar országgyűlés minden különösebb ellenkezés nélkül elfogadta és becikkelyezte, jóllehet összekötötte azt a szabad király választási jog fenntartásával, a török elleni küzdelemhez szükséges támogatás biztosításával, az ősi magyar szabadság, a régi és jó jog betartására tett esküvel, valamint annak hitlevélbe foglalásával, a magyar rendi alkotmány betartásával, ami magyar oldalról relativizálta a feloszthatatlanul és elválaszthatatlanul birtoklandó és kormányzandó monarchia képletét, utóbb éles közjogi vitákra adva lehetőséget.

THE PRAGMATIC SANCTION AND THE HUNGARIAN HISTORICAL CONSTITUTION

SUMMARY

With its 1 to 3 articles the 1723 Pragmatic Sanction, that was enacted in the Hungarian public law, established the principle of female primogeniture in the legal regulation of the succession to the throne, thereby modifying the feudal Hungarian constitution. The paper seeks to answer the question of how far the new regulation was adjusted to the system of feudal privileges and and liberties, and to what extent the Austrian order of succession as accepted by the Hungarian diet was compatible with the feudal constitution. It also examines the issue of legal continuity and the guarantees of feudal public law which could ensure the efficiency of Hungarian constitutionalism, and guarantee the traditional liberties in the new, compliantly accepted order of succession.
