All EU member states including Hungary have ruled out retroactive effect of the Charter of Fundamental Rights that forms an integral part of the revised EU Constitutional Treaty also known as the Lisbon Treaty. In other words, the effect of Beneš decrees cannot be retroactively revoked based on the Charter of Fundamental Rights.
