Theoretical Foundation of the Criminal Justice of the Church

There are many questions about the judicial power of the Church. Here are some of them: where does this power come from? What is its theological basis? How can it be practiced correctly? Which procedural order should be applied? In Hungary, the codification of the Hungarian Reformed Church started at the Debrecen Constitutional Synod of 1881. At about the same time, scholarly church law work appeared, and until nowadays, many renowned ecclesiastical jurists tried to give answers to the questions arising from a theological and a legal point of view. This paper intends to present and summarize all these.
