Gyógyszertermékek szabadalmi oltalma a csatlakozási tárgyalások tükrében II oltalmi tanúsítványok életbelépését követően - hazánkban legkorábban 2010-ben — a társadalombiztosítási rendszerre rövid távon várhatóan megterhelést is jelent, hosszú távon jó alapot teremt a hazai ipar versenyképes, innovatív fejlesztéséhez. Mindennek ellenére úgy véljük, hogy a tárgyalások során született kompromisszum végleges értékelésének még nem jött el az ideje. Az, hogy a megállapodás a TRIPS- egyezmény alapelveinek értelmében „a technológiai haladás, az innovatív eljárások átadása és terjesztése” javára fog-e válni, „az előállítók és a technológiai tudás felhasználóinak kölcsönös előnyére”, „előmozdítva ezáltal a társadalmi és gazdasági jólétet”,61 az még a jövőbeli fejlemények, jogalkalmazás és jogértelmezés függvénye.
