IUS CANONICUM - Szabolcs Anzelm Szuromi, O.Praem., The effect of Pope Benedict XIV’ s canonical works on the ecclesiastical process law
192 SZABOLCS ANZELM SZUROMI, O.PRAEM. propria S.R. Rotae et Signaturae Apostolicae (June 29lh 1908) and the Regulae servandae in iudiciis apud S.R. Rotae Tribunal (August 4th 1910 and March 6lh 1912). However, the most significant influence has been made by the canonical works of Prospero Lorenzo Lambertini, later on Pope Benedict XIV (1740- 1758).111 If we like to get a better understanding of the canonical process law and its theory in the modem age, we must pay a particular attention to Pope Benedict XIV’s writings." These are the followings: Const. Sacramentum Poeniten- tiae (June 1st 1741); Ep. Enycl. Quamvis Paternae (August 26lh 1741); Const. Dei miseratione (November 3rd 1741); Const. Ad Sepulcra (November 23rd 1741); Const. Admilitantis (March 30"1 1742); Ep. Enycl. Cum illudi October 14th 1742); Deer. Cum ex ratione (July XT'* 1744); Const. Inter conspicious (August 29,h 1744); Ep. Sollicitudini (October Is' 1745); Const. Ad universae (September 3rd 1746); Ep. lampridem (February 28,h 1747); Const. Si datum (March 4dl 1748); Const. Quamvis iusto (April 30,h 1749); Ep. Beatus Andreas (February 22nd 1755); and Ep. In postremo (October 20,h 1756). Among his formal publications is the most important one his monography, entitled: De servorum Dei beatifica- tione et beatorum canonizatione.'2 This volume defined for centuries the most important principles of the beatification and canonization process.10 11 12 13 14 Recently, has appeared Benedict XIV’s name in many scholarly analyses on renewing the canonical process by Pope Francis’s MP Mitis Iudex, which was promulgated on September 8lh 2015 and has come in force on December 8lh 2015. The reason is indeed. Benedict XIVs famous constitution Dei miseratione which had introduced the mandatory second instance of matrimonial trials in 1741 with many other refinements within the canonical process law." 10 Erdő, P., Introducilo in históriám sdentine canonicae.
