THE ADJUDICATION OF INTERRITUAL MARRIAGE CASES 265 Conclusion This study has shown that the main problems which come up on a regular basis in treating interritual marriage cases involve both the competence of the Tribunal and substantive marriage law to be applied in the adjudication of such cases. In determining and obtaining competence, it is essential that Tribunal officials recognize the parties’ membership in different Churches sui iuris, and the effect of this difference in determining the domiciles of the parties. In interritual marriage cases the parties will almost always have different domiciles in the territories of different Churches sui iuris. In adjudicating the nullity of interritual marriages, the substantive matrimo­nial law of each party must be considered and applied. In addition to the substantive matrimonial law found in the CCEO, an Eastern Catholic is also bound by the Particular Law of his or her own Church sui iuris. The principal areas of divergence between the two codes are the diriment impediments of public propriety, spiritual relationship and, in older marriages, consanguinity; conditional consent; and canonical form, especially the issue of the sacred rite. The most important thing in these cases is attention to the Church member­ship of the parties.
