1063. Royal Consular-Officiers shall inform the Japanese Local-Authorities in writing of the object of their journey and the place to which they intend to proceed, and shall undertake this journey only in the company of a high japanese offlcer to be appointed by the Japanese Authorities. His Majesty the Emperor of Japán ma,y oppoint a diplomatic Agent at the Court of Vienna and Consular Officiers at any port or town of the Austro Hungárián Monarchy where Congular Officiers of any other power are admitted to reside. The diplomatic Agent and the Consular Officiers of Japán shall under the condition of reciprocity. enjoy in the territory of the Austro-Hungarian Empire the same rights, privileges and immunities, which those of any other Power now enjoy or may hereafter enjoy. AKTICLE III. The ports and towns of Yokohama (in the district of Kanagawa) Hiogo, Osaka, Nagasaki, Niigata, Ebisuminato on the island of Sado. Hakodate and the city of Tokey (Yedo) shall from the day on which this Treaty comes intő operation, be opened tho the citizens of the Austro-Hungarian Monarchy and to their trade. In the above ports and towns Austro-Hungarian citizens may permanently reside; they shall have the right, therein to lease land, to purchase houses and erect dwellings and warehouses. The place, where Austro-Hungarian citizens shall reside and where they shall erect their buildings, shall be determined on by the Imperial and Royal Consular Officiers in conjunction with the competent local authorities; the harbour-regulations shall be arranged in a simular manner. If the Imperial and Royal Consular-Officer and the Japanese Authorities cannot agree, the matter shall be submitted to the diplomatic Agent and the Japanese Gouvernement. No wall, fence or gate shall be erected by the Japanese, around the place where Austro-Hungarian citizens reside, and nothing shall be done there which may prevent free egress or ingress. Austro-Hungarian citizens shall be free to go where they please within the following limits. At Yokohama (in the district of Kanagawa) SZÁM. 251 hivatalnokok azonban kötelesek minden ilyen esetben írásban értesíteni a japáni helybeli hatóságot utazásuk czélja és okáról ós csak is a japáni hatóság részéről kijelölendő magasabb hivatalnok kíséretében indulhatnak útnak. A japáni császár diplomatiai ügyvivőt nevezhet a bécsi udvarhoz és consuli hivatalnokokat az osztrák magyar birodalom mind azon kikötőibe ós városaiba, melyekben bármely más állam consuli hivatalnokai működésre bocsáttatnak. A japáni diplomatiai ügyvivőt és consuli hivatalnokokat a kölcsönösség feltétele mellett az emiitett monarchia területén mindazon jogok, kedvezmények és szabadalmak illetik, melyeket bármely más állam ily hivatalnokai jelenleg élveznek vagy jövőben élvezni fognak. III. CZIKK. A következő kikötők és városok: Yokohama (Kahagawa kerületében) Hiogo, Osaka, Nagasaki, Nügata, Ebisuminato Sado szigetén, Hakodate valamint Tokéi (Yedo) városa jelen szerződés életbe lépte napjával az osztrák-magyar monarchia alattvalói ós kereskedelme számára megnyílnak. Az említett kikötők ós városokban az osztrákmagyar alattvalók állandóan lakhatnak ós ugyanott földbirtokot haszonbérelhetnek, házakat vehetnek, valamint lakásokat és raktárokat építhetnek. A hely, melyen osztrák-magyar alattvalók lakhatnak és házakat építhetnek, a cs. és kir. consuli hivatalnokok által az illetékes helybeli hatósággal egyértőleg jelölendő ki; hasonló módon állapitandók meg a kikötői rendszabályok is. Ha a cs. és kir. consuli hivatalnok és a japáni hatóságok e részben meg nem egyezhetnének, a kérdés a diplomatiai ügyvivő és a japáni kormány elé terjesztendő. A japániak azon helyeket, hol osztrák-magyar alattvalók megtelepednek sem fallal sem sövónynyel vagy korlátokkal élnem keritendik s semmi olyasmit tenni nem fognak, miáltal a szabad be és kijárás akadályoztathatnék. Az osztrák-magyar alattvalók szabadon mozoghatnak a következő határok között: Yokohamától (Kanagawa kerületében) a Rokugo folyóig ós minden más irányban 10 Ri távolságra32*
