Résumé Politics and Constitutional Court: the Creation of the Bundesverfassungsgericht This paper explores the political battles around the establishment of the German Federal Constitutional Court from 1948 to 1951. Since the German political elite agreed on the necessity of a special court which could serve as a guardian of the constitution, the task to institutionalise the court by different legal documents promised an easy job for the founding fathers. In spite of this fact, several particular questions remained unclear: the exact constitutional status of the FCC was one of the most important questions which had not been determined either by the Grundgesetz or by the act on the FCC. This meant that the FCC should struggle for recognition with other political actors while the implementation of its decisions required obedience from the same political actors. This paper summarises the starting point of this struggle by giving an overview of the first steps of the FCC's institutionalisation. 2014. tavasz 131
