A XVIII. század első felében elszaporodó bűnesetek okai között több tényező szerepel. így a háborús viszonyok erkölcsromboló hatása mellett a meginduló elvilágiasodás, a szokáserkölcs gyengülése, a feudális büntetőjog nem mindig szakszerű alkalmazása, mentalitásbeli és pszichikai problémák, az értékek megingása és a feudális közigazgatási hatóságok túlkapásai. Jelen vannak még a mágikus világlátás, a babona, a népi hiedelemvilág bizonyos elemei is a kor emberének tudatában, amelyek nem csekély szerepet játszottak, pl. a boszorkányperekben.

A tradíciók szerepét, amelyek nagyon jelentős erkölcsi értékeket hordoztak, nem lehetett kiiktatni. A magyar paraszti kultúra legfőbb jellemzője ugyanis a szakrális világlátás volt. A világot nem profánként élte meg, hanem egész élete ritualizálásával teremtett összhangot a magasabb, transzcendens rendező elvvel. Bár a tradíciók lassú eróziója nyilvánvaló, de egyre halványuló fénnyel is őrzik az erkölcsi értékek, az emberhez méltó élet felemelő ethoszát.96

Following the introductory special literature remarks, the Author comments briefly on the main features of the first half of the XVIII. century, on the slackening of morals and the murders. After the stealing, robbery and brawling, he remarks on various moral offences and their punishments. Data on cases of fornication, swearing, abuse and slander are presented in the paper. In connection with these we can read of questions of clerical discipline and the role of the Church in the area of morality. We also receive a picture of the punishments meted out in the course of cooperation between the clerical and secular authorities and the various measures taken. He also presents some features of the feudal criminal law.

In relation to the clerical discipline, we are given a picture on the strict moral conception and role of the community, which is followed by discussion on the connection between law and morals, with a glance at some historical points of view. Following a brief analysis of justice, moral standards, the moral customs and the legal customs of the people, emphasis is placed on the moral problems and questionable situation of legal security of the period. In conclusion he attempts to summarise the causes, and comments on the traditional moral values.
