The state Legislature, controlled by Democrats, has been unsuccessful at translat­ing legislation into law when Governor Arnold Schwarzenegger, a Republican, disagrees. Along the same logic, the Legislature stopped the Governor on key reforms that he demanded. So, to fix the problems in Sacramento, the Governor decided to go to the people with his propo­sition listed reforms designed to build a new California. That is the central core of this November 8-th special election. Hard line Democrats will likely vote “no” on all propositions except Prop 79 on prescription drugs and Prop 80 on electric utility regulations. A very strong union chiefs and Democrat lawmakers coalition has been formed to support this position with well over $100 million that will have been spent against the Governor’s position. For example, the teachers union and the prison guards union are expected to each spend $50 million on ads. Straight party Republicans will probably be voting “yes” on all propositions except Props 79 and 80. A strong bipartisan coalition has been formed by the Governor to fight for his positions and over $20 million will be spent by them on ads. Thinking people will know the fight is on for their votes. Here is what I concluded the proposi­tions will do for you or to you. First, let us look at the four reform propositions that Governor Schwarzeneg­ger and his bi-partisan reform coalition supports. Proposition 74 - The probationary period or tenure for new teachers will be stretched from two years to five. In California a tenured teacher is nearly impossible and expensive to fire no matter how bad they are. This longer tenure eligibility will help the schools do a better job of preventing the “lemon” teachers from continuing to teach children in kindergarten to 12th grade . Proposition 75 - Protects state and local government employee union members from having political contributions made from their dues without their annual, permission. Currently, public employee union members are forced to contribute their hard earned money through dues to political candidates. Passage of Proposition 75 will increase the take-home pay of government union members. Democrat and union officials are expected to spend over $100 million dollars to stop Prop 75. Proposition 76 - Limits growth in state spending to the average growth of the last three years. The Governor would be granted authority similar to the governors of 35 states to cut spending in mid year if there is a shortfall in moneys. The Legislature could over-ride the cuts. Proposition 76 is the heart of the Governor’s reform effort to stop the annual deficit spending the Legislature forced on California every year since 2000. Proposition 77 Requires independent retired judges instead of state lawmakers to draw territorial lines and to have the people vote on adopting the new lines. Not a single state legislator or congressional politician in California lost his job last year at an election. The Governor said, “If a poker player can choose his cards he will never lose. No wonder the politicians (drawing their own lines) won every time...and so the people lost.” Also on the ballot will be four other mea­sures. Proposition 73 - Requires doctors, with exceptions, to inform the parents or guard­ians of young girls 48 hours before perform­ing an abortion. Called the Parental Right to Know Act, this notice is similar to parental notices required by several other states. Proposition 78 - Provides low and middle income Californians direct discounts on pre­scription medicines and leaves prescription medical decisions with doctors. Proposition 79 - Creates a big government program costing taxpayers millions that lets bureaucrats decide what medications are cov­ered for discounts on prescriptions. Allows trial lawyers to act as attorneys general to sue over excess drug profits in the name of all California users. Excess profits to be defined by trial lawyers and they get to keep all of the awards without being required to share with all prescription holders. Proposition 80 - Prohibits large electric users from buying electricity from the private market place until 2015. It expands regula­tion over electric service. Opponents claim Prop 80 to be a high risk, anti-consumer, anti-environmental approach to California’s energy future. Concluding about the November 8 special election, Governor Schwarzenegger said, “One way or another, with the people’s help, there will be action this year. With the peo­ple’s help, there will be reform.
